Library of Congress issues new exemptions to DMCA – Jailbreaking iPhones now legal

Library of CongressNot only is jailbreaking your iPhone now perfectly legal, there are other exemptions to the DMCA act that the Library of Congress has just issued.

They include:

  • allow circumventing DRM on DVDs in order to include excerpts into educational materials, documentaries, and non-commercial videos
  • allow cell phones owners to break controls so that the phones can be used on different wireless networks
  • allow video game owners to break protections to correct security flaws
  • allow computer owners to bypass external security dongles if they no longer work
  • allow blind/vision-impaired people to break locks on ebooks so they can be used with read-aloud software.

You may be wondering why there is even a need for such otherwise common-sense guidelines. It just goes to show how short-sighted the DMCA (Digital Millenium Copyrights Act) turned out to be.

Unfortunately, these exemptions expire in a few years and are not permanent laws. It certainly makes trying to be an upstanding citizen a difficult process, especially as so many law-enforcement groups follow the ‘innocence is no excuse’ rule of thumb.

The iPhone is coming to Verizon

iPhone 4At long last after much discussion, the iPhone will be making its debut on Verizon’s CDMA cellular network in January 2011. So far this is unofficial, but was reported by Bloomberg who had 2 sources within Apple/Verizon.

The timing is interesting given that the iPhone 4G was just released on AT&T’s network. Six (6) months is not a terribly long time to wait for Apple’s latest incarnation of the iPhone on an arguably better network. What remains to be seen is what Verizon will sell those phones and plans for and how competitive it will be with AT&T who has recently moved away from unlimited data plans.

Read This Before You Buy an iPhone 4

Whether you have an iPhone or some other phone, now is a great time to move up to a new smartphone like the new Apple iPhone 4, new Android based smartphone like the HTC EVO 4G or HTC Incredible, or even a new BlackBerry, Samsung, LG, or Motorola smartphone. However, before we get into our iPhone 4 vs. Android and others evaluation, we can probably save you some time by offering this recommendation: if you have an AT&T phone then an iPhone 4 is the obvious choice especially if you already have an unlimited data plan. Otherwise, the HTC EVO 4G on Sprint or the HTC Incredible on Verizon is a very tempting alternative to the new Apple iPhone 4. Here’s our analysis based on what we feel are the most important considerations.

It’s official (according to BGR and Engadget), the iPhone 4 pre-orders have been completely sold out and anyone who was actually able to place an order after 1:30p Pacific will get their iPhone between June 25th and July 5th. If you were unable to pre-order, you still might be able to walk in on launch day without a pre-order and get one of the unallocated units… good luck if you try!

Engadget was able to obtain the following confirmation from AT&T:

“Because of the incredible interest in iPhone 4, today was the busiest online sales day in AT&T history. As of Tuesday afternoon, customers who preorder iPhone 4 moving forward will receive their device on June 25 or later, depending on when the order is placed. We’ll email customers with confirmation once their order is placed, and again when it ships. In addition, we will have devices available on a first-come, first-serve basis in our stores beginning on June 24.”

How to get a new iPhone 4G for ‘free’

Recycle!The latest iPhone 4G is about to be launched any day (remember the brouhaha about the missing prototype?) and we’ll bet you’ll be slobbering over that one too. 😉 Sooo… how can you (potentially) get your mitts on that one. For free? Or with a nice discount?

Pretty simple actually – Recycle your old one for dollars. So you won’t get the new iPhone for free if it’s the $200 model, but if you get about $100 for your old model, then that’s not a discount to sniff at.
